1. The service

Fungalscan ("we", "us") provides an iOS application and supporting website that scan skincare ingredient labels and return a verdict (SAFE, CAUTION, or AVOID) based on a curated, opinionated database of ingredients reported by the fungal-acne community. By installing the app or using this website, you agree to these terms.

Verdicts reflect community opinions, anecdotal reports, and heuristic ingredient screening. They are not clinical testing, laboratory analysis, or a medical evaluation of any product.

2. Informational use only

Fungalscan is informational only and is not medical advice, a diagnosis, or a substitute for professional care. Ingredient data and verdicts are provided "as is", with no warranty that they are accurate, complete, or applicable to your skin. Ingredient suitability varies by individual and by formulation. Always patch test, and consult a qualified clinician for diagnosis or treatment decisions.

Fungalscan does not guarantee that any product is non-irritating, allergy-safe, acne-safe, or suitable for any particular skin condition. Fungalscan is not intended for emergency, clinical, dermatological, or medical decision-making.

Analysis depends on reading a label from a photo. Ingredient extraction may contain errors, omissions, or misread text due to image quality, packaging, formatting, or AI interpretation, and a product's actual formulation may differ from its printed label or change without notice.

Any reliance on Fungalscan's ingredient analysis or verdicts is solely at your own risk. You assume full responsibility for any decisions or actions taken based on information provided by Fungalscan.

3. Acceptable use

You agree to use Fungalscan for your own personal, non-commercial use, and not to:

• Scrape, mirror, automate, or otherwise abuse the API or the ingredient database;
• Reverse-engineer, decompile, or attempt to extract source code from the app, except where the law expressly permits;
• Use the service to harass other users, or to misrepresent product safety to consumers commercially;
• Use the service in violation of applicable law.

We reserve the right to throttle, limit, or terminate access for use that breaks these rules.

4. Subscriptions and billing

Fungalscan offers 3 free scans, after which a paid subscription is required to continue scanning. Current plans are:

• Weekly at $4.99 / week, auto-renewing.
• Annual at $29.99 / year, auto-renewing.
• Lifetime at $59.99 as a one-time purchase.

Weekly and annual subscriptions auto-renew until cancelled. Billing, renewal, refunds and cancellation are handled by Apple through your Apple ID, not by Fungalscan. To manage or cancel a subscription, open your iPhone's Settings → your name → Subscriptions. Lifetime is a one-time purchase and does not auto-renew. Prices and plan terms may change for new subscribers; we will not change the price of an existing subscription without notice.

5. Intellectual property

The Fungalscan name, logo, app, website, ingredient database, copy, designs and code are owned by Fungalscan and protected by applicable copyright, trademark and other laws. You may not copy, redistribute, sell, sublicense, or create derivative works from any of it without our written permission. INCI ingredient names themselves are descriptive identifiers and remain in the public domain.

If you believe content or intellectual property is being used improperly on Fungalscan, contact support@fungalscan.app with a description of the material and your contact details, and we will review it.

6. No warranties

To the maximum extent permitted by law, Fungalscan is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that verdicts will be correct for your skin, that the service will be uninterrupted, or that defects will be corrected.

7. Limitation of liability

To the maximum extent permitted by law, Fungalscan and its operators will not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for any loss of profits, data, or skin outcomes, arising out of or in connection with your use of the service, even if we have been advised of the possibility of such damages. Our total cumulative liability for any direct damages will not exceed the amount you paid for the service in the 12 months before the claim.

Any reliance on Fungalscan's ingredient analysis or verdicts is solely at your own risk, and you assume full responsibility for any decisions or actions taken based on information provided by Fungalscan.

8. Indemnity

You agree to indemnify and hold harmless Fungalscan and its operators from any claim, demand, loss or expense (including reasonable legal fees) arising out of your breach of these terms or your misuse of the service, to the extent permitted by law.

9. Dispute resolution and arbitration

Please read this section carefully. It affects your legal rights, including your right to bring a lawsuit in court and to have disputes decided by a jury or as part of a class action.

Informal resolution first. Before starting an arbitration, you agree to contact us at support@fungalscan.app and give us at least 60 days to resolve the dispute informally. Most issues can be settled this way.

Binding individual arbitration. If we cannot resolve a dispute informally, any dispute, claim or controversy arising out of or relating to Fungalscan or these terms will be settled by final and binding individual arbitration, rather than in court, except as stated below. The Federal Arbitration Act governs the interpretation and enforcement of this section. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and may be conducted by telephone, video, written submissions, or in person in the State of Ohio at your option.

Class action and jury waiver. All claims must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. You and Fungalscan each waive any right to a jury trial and any right to participate in a class action. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.

Small-claims exception. Either party may bring an individual claim in a small-claims court for disputes within that court's jurisdiction instead of arbitration.

30-day opt-out. You may opt out of this arbitration and class-waiver section by emailing support@fungalscan.app with your request within 30 days of first accepting these terms. Opting out does not affect any other part of these terms.

If the class-action waiver above is found unenforceable as to a particular claim, that claim will proceed in court rather than in arbitration, while the rest of this section remains in effect. Nothing here prevents either party from seeking injunctive relief to protect intellectual property. Where mandatory law in your country of residence gives you stronger rights, those rights apply.

10. Governing law

These terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-law rules. Subject to the arbitration section above, you and Fungalscan agree to the exclusive jurisdiction and venue of the state and federal courts located in Ohio for any dispute not subject to arbitration. Where mandatory consumer protection law in your country of residence gives you stronger rights, those rights apply.
